Terms of service
DRAFT. This is a draft under legal review. It describes what the app does today, but its wording may change before the app is released.
Last updated: 15 October 2026 (draft)
These terms are an agreement between you and Athena Theatrical LLC ("we", "us") for using AthenaComm, a push-to-talk intercom app for production crews. By using AthenaComm you agree to them. If you use AthenaComm for a school, company or other organization, you agree on its behalf too.
1. Who can use AthenaComm
- Hosts start rooms and hold an account. You must be 18 or older to be a host.
- Crew members join a host's room with its code and a display name, without an account. You may join only rooms whose host invited you (by giving you the code).
- A host is responsible for their room: who they give the code to, and how their crew uses AthenaComm. That includes supervising students or other minors and having any permission their school or organization requires.
2. What AthenaComm is
Live voice communication between the phones in a room over the internet (Wi-Fi or mobile data), with push-to-talk, a lock-on option for talking, host controls, and short "calls" from the host. Rooms have time and size limits that depend on the host's plan.
3. Not a safety system: read this
AthenaComm is not a safety system. It runs over Wi-Fi and mobile data on ordinary phones and networks we don't control. Audio can drop, lag or stop without warning, and a phone's battery, settings, a phone call or another app can interrupt it.
Never use AthenaComm as the only channel for a safety cue: flying, rigging, automation, pyrotechnics, or anything where a missed or late call could hurt someone. Always have a backup your crew agrees on, such as a hard-wired intercom, cue lights or a spotter.
You're responsible for your production's safety procedures. We are not liable for injury, loss or damage caused by relying on AthenaComm for safety-related communication (see section 9).
4. Plans and payment
Free. A free plan with limits on room size and session length.
Paid plans. Paid plans are bought in the app through the App Store or Google Play, and billing, renewals, cancellations and refunds are handled by Apple or Google under their terms. The host's plan covers everyone in the host's rooms; crew members never pay.
Limits and fair use. Each plan has limits (people per room, session length, and usage allowances), enforced automatically. We may change limits or prices for future billing periods with notice, as the stores' rules allow.
Given plans. We may give a host a plan free of charge (for example beta testers). It ends on the date we set, or when we tell you.
5. Your content and conduct
Audio isn't recorded or stored by us (see the Privacy Policy). You're responsible for what you say and type in AthenaComm, including display names and call messages.
You agree not to:
- use AthenaComm for anything illegal, harassing, threatening or hateful, or to impersonate someone;
- record other people through AthenaComm or any other means without the consent the law requires;
- try to guess room codes, join rooms you weren't invited to, or get around plan limits;
- disrupt, overload, reverse-engineer or attack the service, or use it to build a competing service;
- resell or share access to AthenaComm beyond your own production team without our permission.
We may limit, suspend or end access for anyone who breaks these rules or puts the service or other users at risk.
6. Hosts' accounts
Keep your sign-in secure; you're responsible for activity in your rooms. You can delete your account at any time in the app (Account, then Delete account). If you have a store subscription, cancel it with Apple or Google as well; deleting the account doesn't cancel store billing.
7. Changes to AthenaComm and these terms
AthenaComm is changing and improving; features may be added, changed or removed. We may update these terms. For significant changes we'll tell hosts in the app or by email before they take effect; continuing to use AthenaComm afterwards means you accept them.
8. Availability and disclaimers
AthenaComm is provided "as is" and "as available." We don't promise it will always be available, uninterrupted, on time, secure or error-free, or that audio will always be delivered. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent the law allows:
- we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill;
- we aren't liable for injury, loss or damage from relying on AthenaComm for safety-related communication (section 3);
- our total liability for any claim relating to AthenaComm is limited to the greater of the amount you paid us for AthenaComm in the 12 months before the claim, or US $50.
10. Indemnity
If you're a host, you agree to defend and indemnify us against claims arising from your rooms, your crew's use of AthenaComm, or your breach of these terms.
11. Governing law and disputes
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in the county of our principal office, South Carolina.
